Before using the InetPowerServer “Software Product”, this “License Agreement” should be carefully read and fully understood. The use of the “Software Product” indicates the acceptance of the terms and conditions outlined within this “License Agreement”.
The acceptance of the terms and conditions of this “License Agreement” grants you – the “Software User” – a nonexclusive right to install, configure and use this software free of charge.
The “License Agreement” is considered terminated when one or more of the following statements becomes true:
The “Software User” suspends the use of the “Software Product” and removes any data originating from the original distribution archive from all systems. This does not include the distribution archive itself.
A newer version of this “License Agreement” is made available. In this case the newer version may or may not grant the “Software User” a new license.
The owner of the “Software Product” revokes the granted license based on failure to comply with the terms and conditions of the current “License Agreement”.
This “Software Product” is distributed free of charge. The original unmodified distribution archive may be freely distributed as long as no charge is charged for the “Software Product” itself. A small reasonable distribution fee can be charged for media and/or shipping. The “Software Product” can be included on magazine cover disks and in software collections as long as the “Software Authors” is so notified.
Distribution of a modified version of the “Software Product” is strictly prohibited. This includes, but is not limited to, repacking, partly distribution and inclusion in other software products.
The “Software Product” is provided “as is” without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and and non-infringement. In no event shall the “Software Authors” be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the “Software Product” or the use or other dealings with the “Software Product”.
